Transshipment

Q-1)The B/L shows the following details (Port of Loading as per LC is Mumbai):
Pre carriage:Vessel X Place of Receipt:Kolkata
Ocean Vessel:Vessel Y Place of Loading:Mumbai
Port of Discharge:Rotterdam
Shipped on Board notation is as under:
Shipped on board 12.12.09 on vessel Y at Mumbai Port
Will you consider the above as a case of transshipment?
a)yes
b)no

NO! see art.20b. It will be considerered a transhipment , in view of UCP600, only if it occurs between the Port of loading and the port of discharge.

it must be also noted that when goods are shipped in containers, even if place of loading stated in L/C is Kolkata, this would not count as a transhipment (see also art 20 c ii)

'Article 20 c ii' is also valid for the flexibag containers?

No.As per Article 20 (b) of UCPDC-600.
"For the purpose of this article, transshipment means unloading from one vessel and reloading to another vessel
during the carriage from the port of loading to the port of discharge stated in the credit".

The answer is no, see ucp art 20

I have the following question :

Bill of lading is preprinted "received from shipper...",
Place of receipt and port of loading ia Jakarta
Date of issue : 15 Januari 2018
BL showing statement "shipper on board" without adding place, vessel, and date

Is it discrepancy?

This is not a discrepancy as B/L evidences Place of receipt and Port of Loading,Shipped on Board Date.This is an example of Multimodal Transport Document.

Shipment:From any Indian Airport to Chinese Port
Documents:Full set of airway bills consigned to order of ABC Ltd evidencing the flight number.
Transshipments :Not allowed
Which of the following documents are ACCEPTABLE under this LC?
I.Full set airway bill showing shipment from Chennai to Chinese airport,consigned to ABC Ltd on Flight No 172
II.House airway bill showing shipment from Chennai to Shanghai consigned to ABC Ltd on Flight no 172
III.Airway bill showing Shipment from Chennai to Shanghai,consigned to order of ABC Ltd starting Flight No.172 in “Requested Flight”box
IV.Airway bill marked “Original for shipper”showing from Chennai to Beijing,consigned to ABC Ltd on Flight No 171 from MAA to SIN and Flight No.173 from SIN to PEK-Beijing(i.e.using IATA codes)

Hi Pals,

IMHO, the only answer is D, considering art 23 UCP 600 a iv and v + c i than ISBP745 H13 a and H17.
my doubts if evidencing the flight number corresponds to ask for the actual flight number (and date)
other comments appreciated

b) documents to be presented within 14 days after shipment date
c) documents must reach Issuing bank irrespective of L/C available with nominated bank within L/C expiry
d) documents issued prior to L/C issue date acceptable

Q2) port of discharge : final destination

L/C calls for port to port B/L.
44e: Amsterdam
44f: Shanghai

B/L shows port of discharge as Hong Kong and place of final delivery as Shanghai.

is the above B/L discrepant? if yes, please suggest how to correct the discrepancy.

There are my answers:
Q.1>C
Q.2> yes. Port of Discharge is different 44F in LC
Correct: Amend LC, 44F to 44A

or 44F: shanghai to 44F: Hong Kong,
add 44A: Shanghai

Or add 47A clause : B/L showing port of discharge: Hong Kong is acceptable.

Q.3> yes.

Q.4> No. if the B/L subject is only "Bill of lading", you can raise the discrepancy "B/L did not show the carrier name or master." - as per article 20 UCP 600.
Yes. If the B/L subject shows Charter party bill of lading, the signature above is acceptable as per Article 21 UCP 600
.
Q.5> it is partial shipment. the port of discharge of B.L no.1 (Mumbai) is different from Port of discharge of B.L no. 1 (Kochi). - Article 31B UCP 600.
If B/L no.1 ,2 ,3 have same port of discharge, it is not partial shipment. and the latest date of shipment of 1 of 3 B/Ls will be taken for calculation of presentation period (02 Dec).

Shouldn't the 4th option be sufficient to satisfy the condition of full set of Air Waybills as defined in the UCP articles mentioned by you as well as H13a ? As regards H17, there is no transshipment in this case, as goods from Chennai to "any Chinese port" is completed by Flight Number 171 . How does the 1st document add any value to the documentation?
