Dear Experts,

Greetings.

LC mentions the name of the Beneficiary/Applicant as Universal Exports Ltd.

Can the ommission of the legal form/legal status "Ltd." in the name of either of the partys be considered a discrepancy???

I have come across ICC Opinion TA857rev, however, it doesnt clarify much.

Kind Regards,
Saif

Hi Pal,

probably you refer to opinion TA875rev where it is written that the fact that the invoice indicates, as part of the beneficiary details, a company legal form in addition to that indicated in the credit, does not in itself create a discrepancy, in particularly as both legal forms have the same meaning(NV-SA)
IMHO, this has been interpreted as the beneficiary's name is apart its legal status.
Other comments appreciated
Ciao

Hi Pal,

following my post I found a mote concerning the omission of STE'(societe) in the name of beneficiary, Casas Studies on Documentary Credits, case no.130, page 112, ICC Publication no 459/400 1989.
I asked my friend about the original post, in case of receipt I will insert it, here.
Ciao
