BL & Sea waybill

Post by Sharif » Thu Dec 18, 2008 11:04 pm

Dear All

Will appreciate if any explain the differences between Bill of lading, Straight Bill of lading and Sea waybill.

Is there any problem (Regulatory or else) issuing Sea waybill in Bangladesh?

Thanks

different types of bill of lading

if you understand the basic function of a bill of lading, you can easily understand the differences between them. a normal bill of lading has three functions -
1. its a evidence of contract of carriage of goods
2. its a document of title.
3. its a evidence of shipment

in addition to these function, a bill of lading has another characteristics. its negotiable.

a straight bill of lading is not a negotiable document but has the other two characteristics

a sea waybill if not negotiable and is not a document of title. that is its simple a evidence of contract and evidence of shipment.

the question how a straight bill of lading is different from a seaway bill is that for sea waybill you need not to produce the bill of lading to release the goods. but for straight bill of lading you have to. but this is a very tricky difference and in many parts of the world; usa, this difference may not exist at all
