Reimbursement Claim With Claimed Value Date On Swift

Post by ursoul486 » Wed Jun 11, 2014 8:12 am

Dear. All,

I seek your advice regarding the following situation.

===22 May.
I (Nego/Claiming bank) have claimed by MT742 and stated our claimed value date as 27 May 2014 under field 34A with claimed value amount.

===23 May.
Issuing bank authorised reimbursement by swift stating that 'YOU ARE AUTHORISED TO REIMBURSE ON DUE DATE 27 MAY 2014'

===
Reimbursing bank honour the payment to us on value date 28 May 2014 which is one day later than our claimed value date.

===
We claimed interest for the delayed payment and reimbursement replied that they are not liable to pay any delay interest
according to URR (honour claim within 3 working day from the date of MT 742 received(22 May 2014)).

I guess they are trying not to pay the interest, but I actually guess this URR clause applies to the sight claim, not to the usance claim with value date. How should I reply them back with valid reason? Do you think I could quote URR 725, Article 11, C, i. c. "When a reimbursing bank has not issued a reimbursement undertaking and a reimbursement is due on a future date:
i. the reimbursement claim must specify the predetermined reimbursement date"

Or, are they really right to say that

Dear Friend,

As per URR725 article 4, a reimbursing bank is not obligated to honour a reimbursement claim unless there is a reimbursement undertaking isued by the reimbursing bank. If there is a delay in the date of your receipt of funds from reimbursing bank despire LC terms complied with, you may claim interst from issuing bank.

Other comments appreciated.
