As far as I can remember , there was an ICC opinion on the following issue, and I would much appreciate if someone can quote/state in this topic
A letter of credit required a Bill of lading proving a carriage of goods from a port of loading A to a port of discharge B. However, a multimodal B/L has been presented showing port of loading A, port of discharge B and in addition a place of final destination C. Issuing bank claimed B/L was discrepant, but presenting bank claimed that the bill of lading was compliant because between ports required by the credit A - B, the transport was effected by sea only and between this two ports is was a marine B/L. On the other hand the delivery terms was FOB so it was supposed that the applicant who arranged the vessel for loading could give direction to the carrier as to the final place for goods.
So, do you happen to come across with this case and the relevant ICC opinion?
