Demurrage Charges For Late Documents Presentation

Post by Faheem » Fri Mar 17, 2017 10:32 pm

Dear All,
I have the following question and would appreciate your inputs on.

Applicant: In Qatar
Beneficiary: In Dubai
MOT: By Air From Europe

Challenge:
All documents (Invoices, PL, Original AWB, Legalized COO) will reach in Dubai with in 7 to 10 days and we will submit these document to our bank. So approximately it takes two weeks to reach all documents at customer's bank.
On the other side goods will reach second day in Qatar. 12 days demurrage expected.

For sea shipments we have full control as its 4 to 6 weeks to reach Qatar but for Air we have this challenge. Please advise how overcome on this.

Regards/Faheem

Hi Pal,

Normally the AWB is consigned to the issuing bank , On receipt of goods the Air transport agent may require the notify for a bank release to take up the goods. You may ask your bank about.
Risk on goods are possible but your supplier may send you full documentation's copy by email, fax
etc.
Other comments appreciated
Ciao

Demurrage charges for late documents presentation

Dear Faheem !
If the issuing bank do not receive documents under its documentary credit prior to the goods arriving at their destination, the applicant also do not be in possession of an original transport document when the means of transport arrives at the port of discharge/destination. In these circumstances, the applicant will wish to clear the goods despite the absence of an Original Transport Document. To do this, the applicant then request its bank to issue the indemnity or shipping guarantee in a format that will be satisfactory to the carrier.

Again when goods despatched by air generally arrive sooner than the underlying documents. In this case, issuing bank is therefore often called upon to issue an airway release or delivery order to the respective carrier holding the goods, enabling them to be released to the applicant under the documentary credit or its nominee.

Airway releases and delivery orders usually issued by the issuing bank of the documentary credit, addressed to the carrier, and will show some, or all, of:
◆ air waybill number or truck waybill number;
◆ consignor;
◆ carton detail or container numbers;
◆ description of goods;
◆ documentary credit number;
◆ invoice number and invoice amount; and
◆ an instruction to release the goods to the applicant or its nominee.

These releases or orders do not always include an indemnity to the carrier because, in the case of air despatch, the goods are often consigned to the issuing bank. In these circumstances, the release or order serves as an instruction to
deliver goods to the applicant or its nominee.

In view of the above, it is obvious that the applicant can avoid the demurrage charges by releasing the imported goods with the help of shipping guarantee/Indemnity to carrier/ airway releases/ delivery orders.

Regards,
Shafique
