Confirm lc tenor 90 after BL lc calls for FCR draft show 90 days act BL

Hello dear members

I have received a presentation with a draft that shows tenor as 90 days after BL date without indication of the date?

Can I refuse base on the date is missing on the draft?
Since is a FCR no on board date present
Lc missing to indicate that the FVR date should be use as the date of shipment

Hi,

if it is a discrepancy apart from other valid discrepancies then there is no need to look at as serious as we anticipate.

confirmation should not have been added and it should have been highlighted at the time of performing workability. Though one may argue that issuing bank has equal responsibility and may not claim discrepancy even if documents are sent, it is wise to raise it as discrepancy and as per LC terms draft needs to mention bill of lading date(though it is absolutely incorrect to expect it now)

Simultaneously reach out to issuing bank seeking amendment changing this.

What is the transport document required in the credit? FCR cannot be substituted for BL. Since there was no BL presented, you cannot determine the maturity of the draft. It is a discrepancy.

Hi Pal,

collectively the presentation seems ok,
Isbp 745 para B2 indicates the way to link the draft to the proper maturity. Check if b iv assolves
the requirement.
