Endorsement but how?

Post by gondem » Tue Jun 16, 2020 11:39 am

Dear all,

How do you endorse a B/L? What do you write on the back of it?
We have two containers shipped from the South Korea and to be delivered to our customer in Greece.

I will stamp the back of the B/L and write above 'Release to xyz company' and then sign the bottom of the stamp.
Is it sufficient and acceptable?

Hi Pal,

correct if you write: DELIVER TO THE ORDER OF (name of the buyer or other) and duly signed by the
prior consignee.

If consigned to the order of a bank, endorsement with a clause that the liability of charges and fees
must be borne by the assignee is advisable.

I dare say tht, specially when documents sent on collection basis, the bank is only a medium to transfer the title, not entering in the ownership of the goods.

Further Comments appreciated.

Ciao

Hi Picant.
Thank you very much for the explanation.
I will use the phrase you suggest which is 'deliver to the order of xyz company'.. It seems proper enough.
Have you ever involved such a transaction?

Hi Pal,

in import, Pakistan and Bangladesh, just to mention a few, require that the bill of lading must be
made out to the order of negotiationg bank in Pakistan / Bangladesh and endored in favour of the
issuing bank in Italy. So when we receive such bill of lading, before delivering to the applicant, we
endorse it in favour of the same applicant. Italian Banking association (ABI) in the past advised banks
to a wording for correct endorsement continuing to appose in brackets a notice that charges and fees regarding the goods were for the applicant/buyer/importer, I think to state that the bank was a professional entity acting in this way to facilitate the trade.
As when a bank endorses a cheque, clausing the endorsement with "For collection only" clause.
Comments appreciated, as different laws may be applied . Ciao
