the definition of PRESENTATION

Post by loankim » Tue Apr 21, 2009 3:36 pm

Hi all,

If L/C states in field 47A that : The Bene has to delivery docs not later than 7 days from B/L date.

Can I understand that delivery means that presentation ( basing on the definition of presentation ) to the Issuing bank ,though it does not mention anything about presentation and the Issuing bank ?

Hi friend,

According to UCP600, presentation must be made either to issuing bank or nominated bank. Therefore, presentation can be made directly to issuing bank.

And Can the issuing bank be understood is the attention though that statement does not mention he???

presentation

i will consider the term similar to presentation. the intention of the issuing bank is quite clear. besides, the definition of presentation actually include the word "delivered"

Hi all,

thanks for yr sharing , i also think that Delivery of documents (or presentation
as it should read) is to be made to the bank with whom the LC is available. This may or may not be the issuing bank.
I have just got this confirm from a famous credit document specialist .

an ambiguous term

Post by pebble » Wed Apr 22, 2009 4:15 pm

dear loankim and shahriar,
I still feel ambiguous about this term: "The Bene has to delivery docs not later than 7 days from B/L date". If just base only on this sentence, how do we know that is the requirement for the presentation document of Beneficary to claim an honour from nominated/issuing bank. What is the docs here, and where it be sent ? It can be a non-document condition, it can mention about the delivery of docs outside this LC, to applicant ! And if the LC has Field 48 show another period of presentation, how can we deal this matter ?
Hope you guys reconsider this issue, and share us your opinions !

humm if there is another presentation period, then i must take the old contingency approach; ask the issuing bank for clarification :D

otherwise, i will stick to my earlier thought.
