would appreciate your opinion
the lc calls for a
"certificate from the shipping company stating the the carrying vessel is less than 10 years old"
the document was presented on 10th june 2008. the bill of lading date was 5th june. the certificate shows the wording required in the credit but the date of the certificate is 05-06-2000. may be thats a typo. but even then for educational purpose; whats your opinion if its not a typo.

If L/C does not prohibit the docs dated prior to date of shipment or date of Issuing the credit and the data of the shipping company certificate does not stipulated other in the credit than the documents so presented is acceptable.

Dear concern
This certification arises confusion as this also may take under consideration that the certificate may actually issued on 05-06-2000 and at that time the vsl was less then 10 years old. In this case the certificate may not comply.

As per my analysis, the certificate is fully in line with the UCP and ISBP. On 05-06-2000, it is very much possible that the ship was only 1 day old!! To avoid such situation, I think the LC clause should have been written as
“"certificate from the shipping company stating the carrying vessel is less than 10 years old as on date of shipment” or “as on 01-01-2008.”
Now lets discuss a bit more. Take that it’s a Charter Party BL, a bare boat charter and the certificate is given by the master of the ship.
Whats your opinion on the clause now?

I agree that certificate is acceptable.
There is no requirement in LC terms that the certificate to be issued on shipment date.
Banks will accept as presented the documents other than transport docs, insurance docs and commercial invoice, which comply with the LC terms.

My view
As long as the credit does not exclude art 14i, the contents of the document create the possibility of understanding that age of vessel is 8 years old at the time of presentation.

In my opinion, we can accept this certificate, the date under this certificate does not serve any purpose. Should it be in the B/l it could have made difference, as this date is important to calculate the presentation period.
