Hi Pals

Art 28 states that:
the insurance document must be dated no later than the date of shipment or provide evidence within the document that cover is effective no later than the date of shipment.

I noted that in a FM WAREHOUSE TO WAREHOUSE Insurance certificate the back datation has been made for only 10 days causing a discrepancy in documents:
-On board date in bill of lading August 19 date of insurance certificate September 13, the certificate states cover effective from September 3.
It is Insurance Companies practice to do so or limited to that insurer?

dear picant,

if the insurance certificate shows a warehouse to warehouse clause, then it should not be a discrepancy. i remember ICC position on this.

Hi,

i have read this in Commentary on UCP 600.

Some ICC national committees suggested that the date of an insurance document which is latter than the date of shipment should be acceptable, since the Institute Cargo Clause cover the "Transit Clause" as indicated in the policy. The insurance attaches from the time the goods leave the warehouse or place of storage at the place named therein for the commencement of the transit.
However, the principle of examining a presentation to determine, on the basic of the documents alone, whether ot not the document appear on their face to constitute a complying presentation, applies. In respect of sub-article (e), a document examiner is not expected to check details of the specific Institute Cargo Clause to ascertain the effective date of cover.
