shipping mark N/M, Inspection Report bearing round chop

Post by ucp800 » Thu Jul 15, 2010 8:31 am

Dear Expert,

May I ask for your opinion of the following :

L/C request :

1. INSPECTION CERT. ISSUED BY MOODY INTERNATIONAL.

2. B/L MARKED FREIGHT PREPAID, SHIPPING MARKS AS PER ORDER

DOCUMENTS PRESENTED :

1. INSPECTION REPORT ISSUED BY MOODY INTERNATIONAL
BEARING A ROUND CHOP (SHOWING MOODY INTERNATIONAL)
PRESENTED.

2. B/L AND OTHER DOCUMENTS SHIPPING MARK SHOWING “N/M”

DISCREPANCY CITED:

1. INSPECTION REPORT I/O SIGNED INSPECTION CERT. PRESENTED.

2. B/L SHOWING SHIPPING MARK NOT AS PER L/C STATED.

Please comment whether discrepancies are valid or not.

Thank you for your assistance.

Regards,
ucp800

Discr no. 2

Post by Bhagirath » Thu Oct 28, 2010 9:55 pm

Dear Friend,
my opinion is discrepancy no. 1 with regard to Insu cert is correct.

However, discr no.2 with regard to B/L may not be correct as credit is making reference to another document (order) which can not be considered as part of credit.

No discrepancy

Hi there,
in my opinion :
1. No discrepancy , because:
Acorrding to ISBP para.22, " issued by..." may appear as "signed by..." and a signature can be satisfied by a stamp, symbol ( such as chops ) as per para.39
2. No discrepancy, because :
i think "SHIPPING MARKS AS PER ORDER" isnt a detalied shipping mark. By stating like that imnot sure the purpose of a shipping mark in identification of a box, bag or package will be sufficient. So i think para.34/ ISBP 681 which requires to showi the detail of shipping mark isnt applied here.
im doubt even the truth that this B/L must be checked with requirement stated in the credit in raising a discrepancy like that.
.
Your comments appreciated !

more detail

dear UCP600,

no comment on no. 1 as we need more detail of the document. better attach the document here. just for reference, a report and certificate is not the same thing. please give us the exact LC clause and the document.

no. 2 is not a discrepany in my opinion.
