Does Copy Document Need To Be Presented Within 21 Days?

hello friends,


article 14 C says a presentation along with one or more transport document must be presented within 21 days from the date of shipment. i was wondering if the LC calls for copy of a transport document and in 47 says that the document must be presented within 15 days from the date of shipment and the copy of transport document does show the date of shipment clearly, does the documents need to be presented within 15 days?

Dear,
Article 14c talked about a presentation including one or more ORIGINAL [EMPHASIS ADDED] TRANSPORT DOCUMENT.........

SO IF A CREDIT CALLED FOR COPY TRANSPORT DOCUMENTY THE ABOVE ARTICLE IS NOT APPLICABLE.
THE ABOVE PROVISION IS ALSO UpLIFT BY ISBP PARAGRAPH 20:

20. Copies of transport documents are not transport documents for the purpose of UCP 600 articles 19-25 and sub-article 14(c). The UCP 600 transport articles apply where there are original transport documents presented. Where a credit allows for the presentation of a copy transport document rather than an original, the credit must explicitly state the details to be shown. Where copies (non-negotiable) are presented, they need not evidence signature, dates, etc.

please read my post again. however i am repeating "47A mentions document must be presented within 15 days from the date of shipment and Copy TD does shows the shipment date"

here i mentioned some of the parameter :[pls ractify me if i am wrong]
1. copy of transport document is not a TD and thereby will not be examined on the basis of transport article from 19-25.
2. copy of transport document must be examined on the basis of sub article 14(f).

if you agree yes or no.
if no...... i have nothing more to add at this moment.
If yes...... you cannot back to original transport article i.e [19-25]
for examine of this copy transport document. you have to examine the same as per article 14(f).

you didn't mentioned on your credit, how will you determine shipment date and so you cannot presume the shipment date on the basis of 20(a)(ii), because the data contained on that article is SOLELY FOR ORIGINAL TRANSPORT DOCUMENT[EMPHASIS ADDED]

YOU DIDN'T MENTIONED THE DATA CONTAINED OF YOUR COPY DOCUMENT. SO MENTIONING A CLAUSE THAT ASKED FOR:
"transport document must be presented within 15 days and a certificate to this effect must be presented"
HAS GOT NO RELEVENCY TO ME, BECAUSE, YOU DIDN'T ASKED FOR A TRANSPORT DOCUMENT,

HERE I HAVE PUT MY LOGIC ON ABOVE THINKING:
LET BREAK DOWN YOUR STATEMENT IN TWO PART:
TRANSPORT DOCUMENT MUST BE PRESENTED WITHIN 15 DAYS;;;;;;
NO TD ASKED FOR.
A CERTIFICATE TO THIS EFFECT MUST BE PRESENTED.
THIS PART MAY CREAT DOUBLE STANDARD EXPPLANATION WHICH VARIES FROM BANK TO BANK.
MY THINKING:
SINCE THE CERTIFICATE IS BASED ON TD AND NO TD ASKED FOR, ONE SHOULD HAVE TO ACCEPT IT "AS PRESENTED- AS PER SUB ARTRICLE 14(F) [EMPHASIS ADDED]
.
THE ISSUING BANK SHOULD HAVE TO PRECISE AND EXPLICIT WITH ITS WORDING.
THE BENEFICIARY SHOULD HAVE TO ASKED FOR AMENEDMENT.
THE NOMINATED SHOPULD ASKED FOR EXPLANATION BEFORE TAKEN DECISION.
I DON'T UNDERSTAND, WHETHER IT WILL RELEVENT TO THE TOPIC OR NOT, IF NOT PLS IGNORE IT.

i don't understand what do u want to mean. you said document must be presented within 15 days???!!!??? 15 days count from which point...........................................................if no stipulation................ how come certificate presented.......................then...............'as presented' principle may apply...............................

"documents must be presented within 15 days from the date of shipment. beneficiary must issue a certificate stating that documents have been presented within 15 days from the date of shipment."

dont be so harsh on yourself dear shahriar :) it happens sometimes.

i have read a similar question somewhere. sorry i forgot the reference. anyway, as per your last post, the document must be presented within 15 days since the condition is successfully modifying the existing rule of the UCP600.
