sender of courier receipt

Dear Expert,
May I have your comment of the following:
L/C term:
Beneficiary’s Cert. certify 1 set non negotiable documents send to
Applicant by courier, an original courier receipt enclosed.
Courier receipt showing sender differ from beneficiary.
Can I treat it is not a discrepancy?

Dear ucp800,
It will be discrepency if LC stipulates that the non-negotiable copy to be sent by beneficiary.Only courier awb issued by beneficiary is acceptable.

I personally think there is no reason to regard it as a discrepancy, unless the credit did not stipulate that the courier receipt must show the beneficiary as sender. It is possible for the beneficiary to send the non-negotiable docs through its bank or other agents.

Hi all,
i agree with you, i wont treat this courrier's receipt as discrepant doc.
from the requirement of credit , the beneficiary is only the position of the issuer for his certificate including the content as credit stated.

Hello All
Just joined this forum and I find it very useful and interesting.
I do not think this is a discrepancy. The sender in a courier receipt need not necessarily be the beneficiary unless the LC requires it to be so.
However, a bene certificate must be issued by the beneficiary and hence don't see this as a discrepancy.
