puzzled question

Dear,

I got puzzled by your question.
"shipper" is a vague term cause it can be used in both contract of carriage and BL. If the deal is based on FOB, then the problem is the shipper is the applicant (under LC) in contract of carriage. But whether the shipper in such circumstance is still the applicant in BL leads to disputes. Some insist that the shipper is the beneficiary while some others may think the applicant is also the shipper in BL.

To me, I would suggest that the BL use "consignor" to replace "shipper", then the disputes will not exist.

article 14k of UCP 600 should be enough to support

k. The shipper or consignor of the goods indicated on any document need not be the beneficiary of the credit.
