Pre Shipment Inspection Says Goods Are PSI Exempted

Dear Sir,
Recently, I have gathered an exprienced to check an import documents. Let, Our L/C contain the PSI (Pre Shipment Inspection Clause), But The documents we received against the following L/C, not endorresed by PSI Company and contain a decleration by the PSI Conmpany,that the stated goods are PSI exempted goods. Will the documents be discrepents in the light of UCPDC-600?

Sorry I didnot understand what meant by "...The documents we received against the following L/C, not endorresed by PSI Company..." Should all the docs be endorssed by PSI company?

As per article 14(f), content of the document should fulfil the function of required document. Here, the declaration of PSI company that goods are exemted, may violate this article.
.
I may misunderstood the case, would like to see comments of more experienced friends.

Does the credit require a DOCUMENT to establish compliance or is just a clause inserted in field 47a.

dear Probal,

i think i can read your mind. dear cristian and navi, we need to understand the local practice for this. so far i understand the case is

the PSI is a custom requirement by law for tax assessment purpose. however some of the items are exempted; like capital machinery since there is no tax on them. the enlisted PSI company has there office at the importers therefore PSI company only inspect taxable items usually. such PSI clauses are also written in unique ways and hardly bind the beneficiary.

therefore i see no problem as far as custom is concern. but it will all depend on how the clause is written. probal; could u please quote the clause?

this is indeed a tricky issue. even if i take that such inspection is just a custom requirement and is waived in this particular case, still its a binding as per credit and must be complied. its the responsibility of the beneficiary. however the wording of the clause is important. if the wording says that the inspection is to carried out, then the document is discrepant. if the cargo doesn't require a shipment, then the LC had to be amended.
