middle man wants to show them as shipper on bl

hello
I need to export some material. A LC has been opened by the importer. Later I came to know that they are not the actual importer and the LC was transferable. I should have understood this before while having the LC. my bank didnt tell me.

Now, the middle man wants us to prepare a bl in which the shipper is the middleman, not us. They say they don’t want a to issue another BL. How can they issue another BL? Do you think that making such bl will make them discrepant? Please help me on the issue.

Hi Pal,

Art 14 k UCP 600 is clear about your request, I think that the delivery term(FOB, EXW etc) will be followed. However if you have a negotiable bill of lading, duly issued or endorsed in your favour or in blank, you will have the controll of goods until presented to the issuing bank, directly or via your bank, for payment.

i think you should have no problem showing the middleman (or i should say the first beneficiary) as the shipper. as picant rightly pointed out, shipper can be anybody other than the beneficiary. since the lc is transferable, i take there is no restriction on third party shipment.

about issuing new bl... the only option coming into my mind is the switch BL; that is the carrier will issue a new BL to the first beneficiary given that the BL issued to you is surrendered; one of the ugliest practice in shipping industry. hope that will help

i just came up with a thought. will these change in BL cause a problem with the insurance?
