Bill of lading is claused

Post by berry » Mon Dec 22, 2008 1:24 pm

Dear all,
I just received a bill of lading which shows
FRT Covered under O/BL KKLUTW201577. This is not the bill of lading no i have in hand but similar. Just the last three digit is different. Is the delivery under this bl is dependent on other?

Meaning??

Post by picant » Mon Dec 22, 2008 1:41 pm

Hi Pal,

The meaning of the sentence seems " Freight covered under other Bill of lading KKKL..........." but does not mean that your cargo will be released only by presenting your and another bill of lading. If freight is to be paid, and it is written in Bill of lading 2Freight prepaid", it is OK, if "Freight to collect" such sentence seems to me the same as "freight as agreed" or the like. So, and naturally without seeing the document, IMHO the bill of lading is OK:

Freight

Without seeing document If such wording claims to substitute a requirement for a notation freight prepaid or freight colect the document is discrepant. However if document has a mention freight prepaid or freight collect as required by credit , then it doesn't matter under what condition the freight will be realised.

Hi Pals,

Please read the a.m. opinion that states:

Bill of lading marked "freight prepaid" but claused "For freight prepaid bill of lading, delivery of cargo is subject to realization of cheque"

The credit requires presentation of a bill of lading marked"freight prepaid" . The bill of lading was so marked, but contained preprinted wording that provided qualification of any notation of "freight prepaid".
It should be noted that banks are not required to examine the terms and conditions of a bill of lading to determine compliance (sub article 20 (a) (v).
