cancel of endorsement

dear all,

we received a set of document which was discrepant. however the document somehow managed its way to delivery section and the people there mistakenly endorse the document in favor of the applicant. we are still holding the document. now we wish to cancel the the endorsement. how can we do so. will a simple pen through the endorsement validated by a authorized signature work? if we can cancel the endorse without the involvement of the applicant, then my question is what is the security the applicant has in case of a valid endorsement. i mean if the endorser can somehow manage the document and cancel, how the right of the applicant will be protected? is there any other way to cancel an endorsement?

Hi Pal,

IMHO, endorsement in your favour is not enough to take upo the goods, you have to present the original bill of lading too, on the contrary a blank endorsement makes the bill of lading a bearer bill of lading, so if you lose it somebody could withdraw goods. In my Country, cancelled endorsement on Bill of lading is deemed to be never effected, consequently prior endorsements must be in line. Than if you think that you are incurred in a forgery or a clear fraud, call the Police Authority.
