Designated issuing party in AWB need to indicate name of car

Dear Sir,

I would like to obtain your kind opinion.

If L/C required an air transport documents issued by ABC Logistics Ltd.

AWB issued and signed by ABC Logistics Ltd on the column of "Signature of Issuing Carrier or its agent".

Is this already fulfilled L/C requirement and no need to indicatie name of carrier and capacity of signer while AWB's issuing / signing party are as per L/C? If yes, is there any ICC opinion to be supported?

If not, what should be discrepancy -- Not clearly indicate the name of carrier and/or capacity of signer?

Hi Pal,

IMHO, if an AWB in box AIRWAYBILL ISSUED states BY XYZ, and in in box SIGNATURE OF ISSUING CARRIER OR ITS AGENT indicates XYZ, it is a qualified CARRIER air way bill and must be accepted, as a bank clerk could not have an uptodate experience in other fields. However there are, so called, educational in DC Insight Revue. i.e. volume 1 no 4 autumn 1995, pag. 10. I will try tomorrow to scan it and post i for a general knowledge.

That means if AWB issuer is made extactly as per L/C required. AWB no more need to identify the name of Carrier and its capacity? Issuing bank has no ground to refuse the documents? Is this also applied to B/L issuer?

If an AWB indicates it is issued by XYZ by using its letterheads (top right corner) and then in box SIGNATURE OF ISSUING CARRIER OR ITS AGENT indicates XYZ only without naming the actual function I would not accept such a document as it does not clearly show the capacity of the signer and I cannot reply only on the assumptions that It would be the carrier.
However, it is a practice that AWB is filled in the box named First Carrier (somewhere in left columns above the name of airports) with the actual name of the carrier and hence to comply with UCP.

in my opinion, the AWB is discrepant. the term signatures of the issuing carrier or its agent does not clearly shows whether abc is agent or the carrier.
