One should make the difference between the wordings : ' signature' and ' be signed' the latter falling under art. 3 paragraph 3 whereby any form as described will be considered under a requirement of a signed document
For clarification of wording 'signature' pls check next paragraph of same art where the difference is self understood : .. signature, mark, stamp, simbol.... as they are treated under separate scenarios
And to reply to original post:

All forms declare a document as being signed (not bearing a signature) , see the difference ?

Jmitra, I think you should consider the fact that under your quoted cases ...any signature stands under umbrella of of 'being signed'. You are separating the context in this matter and i believe you just want to catch and interpret any word as you like. I also noticed that when some people ask a particular questions, other members try to share their knowledge but under a different case. Please re-read the original query
I agree with cristiand969

first, to be honest, i am not very sure about the question. if i am not making mistake, the original question is whether a round stamp is a signature or not. am i correct?
well if yes, then my answer is, if the stamp involves some form of signature (anything that look like human signature), the its a signature. a simple stamp with company name is not a signature.
also not sure whats the problem about sign and signature. as cristian said, a document is signed when it has a signature!! the better question should be what constitute a signature. to me any mark which communicates authenticity is a signature.
did i understand the topic correctly :?: :?
