Commingling (or “commingled/commingle”) shipment refers to the accidental commingling of goods in connection with ocean freight shipments. In particular, natural gas and oil shipments are frequently declared as “commingling shipment”.
Commingling may also occur during the discharge of bulk cargo. The risk involved: the individual batches are not always correctly measured so that the recipient may possibly not receive the correct quantity of the goods ordered.
In such cases, the carrier excludes his liability for the consequences of a possible commingling of goods by adding a corresponding note to the sea transport document that may be worded as follows:
“This shipment of xxx metric tons was loaded on board the vessel as part of one original lot of xxx metric tons. For the whole shipment xxx sets of bill of lading have been issued. The carrier does not assume any responsibility for the consequences of commingling or separation of the shipped goods at the time of delivery”.
