dear all,
i need your help. does certification or legalization on a document makes it original. one the LC clause calls for a original invoice to be certified by the inspection company. the presented invoice was a photocopy but was certified by the inspection company. we are having divided opinion on whether to treat it as an original or not.

Dear jabra
Does certification or legalization on a document makes it orginal ?
refer art 17
No they are not issuers of document.
2 Photocopy certified by inspecting company make it original ? NO as they are also not issuer of documennt.

A copy of document can only be made original only if the issuer of the document has certified it at as such.
An invoice is issued by the beneficiary. Therefore any legalisation / certification on a COPY by another party cannot make it an original.
However, since we're taking about an invoice, the beneficiary can easily rectify this situation by marking the copy of the invoice as an "original" and placing an "original" signature on it.
