I have encountered the following scenarios recently, would like to know if these will lead to discrepancies. I hope you guys can help , appreciate any opinions for discussion, thanks in advance!

Scenario A

LC field 47A clause 1 mentions : Commingled Shipments Allowed.

Ocean BL states:
- 1 container and part of 2 containers
- one of the two cargoes in container no. ABCD123456
- one of the two cargoes in container no. EFGH123456

Question: Does the above statements signify a Commingled Shipment? If yes, 47A clause 1 applies, and thus no discrepancy?

Scenario B

LC field 47A clause 1 mentions : Commingled Shipments Allowed.

Ocean BL states:
- Other BL(s) are involved in the container(s) covered in this BL.
- Delivery shall only be made only against surrender of each one original BL of all other set(s) together with this BL.

Question1: Does the above statements signify a Commingled Shipment? If yes, does 47A clause 1 applies and thus no discrepancy ?

Question2: Or, Does ISBP Para E28 apply here? Regardless of 47A clause 1, it is a valid discrepancy?

Hi Pal,

Commingled bill of lading is, in my opinion, a document indicating that the relevant goods are a part of
a bigger quantity. So buyer must present it to obtain the correct quantity of goods by the ship agent or
delivery agent at destination port.
So details concerning delivery terms and containers status will play a big role.

In your case A, you will present a bill of lading to obtain your own goods. in case B you will
get the goods by presenting the bills of lading required.

Thanks for your input Mr Picant. Still, I wonder if the ISBP paragraph E28 applies in scenario B, despite the Lc clause mentioning commingled shipment allowed.
