BL marked Freight option mandatory or not

Dear all

Usually in 46A, there is a clause like

FULL SET 3/3 ORIGINALS BILL OF LADING MARKED FREIGHT ....., ISSUED TO ORDER OF......

My question is Why the "MARKED FREIGHT ...." part is important. My buyer does not want to include this in the LC, where as my bank wants this to be included. Can anyone please shed some light on this?

Hi Pal,

freight is an important part of the voyage cost, so, depending on the incoterms/delivery terms it must be included or not in the goods price. If the freight has been paid or not it is written on bill of lading or other transport documents as notice for the people involved.

Thanks for your reply. I understand the writing on the BL is important. But when the LC mentions the incoterm as FOB, why we need to have this mentioned in 46A?

Hi Pal,

few Incoterms may be used in l/c. FOB indicates that the transport contract is borne by buyer, so bill of lading belongs to the latter, but having the issuing bank considede the control of the goods it requires such document in l/c.

I think that the only incoterms valid for l/c are CIF and CFR, as the request of bill of lading satisfyes the bank request in l/c.

Other incoterms should be adjusted.
