Determination of Shipment Date When BL Has Multiple On Board

Post by sreekanth169 » Fri Mar 23, 2012 6:12 pm

Dear All
As per UCP, Under one preentation if multiple B/Ls are presented then the latest or the last onboard date shall be considered as a shipment date. But if there are multiple on board dates in a single B/L then why the earliest is to be considered as the shipment date.
Kindly provide your valuable opinions on this query.

Shipment date

Post by amod » Fri Mar 23, 2012 7:55 pm

Dear Sreekanth,

Generally one Bl is issued which cover the entire journey of the goods. Hence if two on board notations are present in a single BL it indicated that transhipment has taken place.

Hence the earliest of the on borad notations is taken to be the date of shipment which is the one at the port of loading

Hope it answers your query

LC required : 100 televisions
1. Many BLs in 1 presentation:
BL 1: 20 televisions from port A to port Z date 20march
BL 2: 30 televisions from port B to port Z date 24march
BL 3: 50 televisions from portC to port Z date 26 march
We take the latest as all 100 televisions are on board
2. Many onboard days in 1 BL : transhipment, we take the earliest, as all 100 televisions are on board

shipment date

The first situation is that envisaged under an LC which allows partial shipments, and for the purpose of determining latest presentation date . The second sitiuation is that envisaged under an LC which requires determination of a due date from date of shipment.

In any case, where a B/L contains different on-board dates, the only issue that an examiner is required to consider for the purpose of a presentation period. or whether the latest date of shipment has been complied with, is which of the on-board dates is relevant for the purpose of determining whether shipment has been effected from the LC designated port of loading/place of receipt.

So, for example if an LC calls for shipment from Rotterdam to Harwich, but the B/L evidences two on-board dates ( an earlier on-board date may relate to shipment from Dubai to Rotterdam, for example), the examiner would only be concerned with the on-board notation at Rotterdam in order to determine compliance with the latest shipment date, and for the purpose of determining latest presentation date.

Deermination of Shipment Date

Dear Amod
Doubt if transshipment has got to do any thing in such cases.
As the different on board dates are naturally created within the same B/L either with in the permitted port of loading or within the range of permitted ports, hence the transshipment is out of the consideration as to determine the Shipment Date.

Dear nmtuyen
In multiple onboards in a single B/L the consignment is getting completed only on the last onboard date and not on the earliest on board date – ok.
Hence the question still remains the same that why ISBP wants to take the earliest date for such cases.

Dear Abrar
The idea of the examiner is here not to read the document as per the LC T&C but to identify that whether the docs are compliant by face of the documents, however this looks to be a separate item.
But in your example you have rightly mentioned a case but still could not find any logical explanation/reason as to why the earliest date should be determined as Shipment date.
Request you all to follow the below example and guide further.
Extract from LC
Goods Description : 4 Industrial Tractors.
Port of Loading : Any European port
Latest Shipment Date : 29th February 2012.
Presentation :
B/L showing Port of Loading as Rotterdam.
1st Tractor onboarded on : 2nd February 2012
2nd Tractor onboarded on : 3rd February 2012
3rd Tractor onboarded on : 5th February 2012
4th Tractor onboarded on : 4t February 2012
Kindly provide the latest shipment date and reasons for choosing such date.
