Have you ever read such a letter of credit?
On one of the terms and conditions , it shows "A DISCREPANCY FEE OF USD76.00 AND ALL RELATIVE SWIFT/TELEX CHARGES INCURRED ARE FOR ACCOUNT OF BENEFICIARY WHICH WILL BE DEDUCTED FROM THE PROCEEDS ON EACH SET OF DOCUMENT PRESENTED WITH DISCREPANCY (IES). "
On the other terms and conditions from the same l/c, it shows:"A DISCREPANCY FEE OF USD90 AND ALL RELATIVE SWIFT/TELEX CHARGES INCURRED ARE FOR ACCOUNT OF BENEFICIARY AND WILL BE DEDUCTED FROM THE PROCEEDS"
If discrepancies really incur, which terms and conditions will be subject to?

i think this is a clear mistake from the part of the issuing bank. you should sought for clarification.

Seek clarification from the issuing bank. it is clearly a mistake
