Can Issuing Bank Send Amendment Bypassing Advising Bank?

Post by nesarul » Sun Jun 29, 2008 7:16 pm

Dear All,
A credit has got the following information:
1. Advising Bank: Bank X
2. Advised through Bank : Bank Y. [beneficiary's requirement through profoma invoice and subsequent request from the applicant]
the issuing bank made a advised through condition on the credit due to not having correspondent relationship with "Bank Y".

later on, the issuing bank completed its correspondent relationship with Bank Y,

then after, the applicant approached issuing bank for an amendment of its above credit.

Can the issuing bank directly send the amendment to Bank Y, despite there is a provision in UCP-600 9(d)?
Regards
Nesar

Dear Nesar,

i think the rule is quite clear. besides by doing so there is a possible problem. earlier the bank Y checked the authenticity of LC with bank X. having the amendment directly from you may cause unnecessary complexity.

If the credit is available with the issuing bank by payment I don't think any problem will occur.

dear navi,
i dont think its related to the availability of a credit. any bank will ask for the original lc and amendments for negotiation and if the beneficiary has that, there is no problem. the only possible problem is in checking the authenticity.

and dear nesarul, shortcut are often full of ditches

Dear all,
thnaks for your valuable posting.
Regarding apparant authenticity:
When the original credit sent via first advising bank, the apparant authenticity of the credit has already been established by the first advising bank. is it not? is there any other problem.
pls help
